1. Acceptance of Terms

By signing up for the BLUE IV Membership or any services provided by Napa Valley MIT, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

2. User Information and Eligibility

Eligibility Requirements:

  • You must be an individual verified by our Medical Doctor to receive IV therapy.
  • Services are limited to consumers who meet medical criteria for IV therapy.
  • You must be at least 18 years old or have parental/guardian consent if under 18.

3. Scope and Use of Services

Service Description:
The BLUE IV Membership includes:

  • IV Therapy
  • Medical Concierge Services
  • Medical Assessments
  • On-Demand Medical Testing
  • Other related medical services

Permitted Uses:
Use the services as directed by Napa Valley MIT healthcare staff.

Prohibited Uses:
Users are prohibited from:

  • Self-administering IV therapy.
  • Providing false or misleading information.
  • Engaging in high-risk activities during or after treatment.
  • Misusing medical advice.
  • Exhibiting aggressive or abusive behavior toward healthcare staff.
  • Interfering with treatment in any way that compromises safety.
  • Violating applicable laws or regulations.

4. User Accounts and Registration

Account Requirements:
Upon registration, users must provide:

  • Email address
  • Phone number
  • Payment card information

Users will receive a unique username. You are responsible for maintaining confidentiality of your password.

Termination Conditions:
Napa Valley MIT reserves the right to suspend or terminate accounts for violations of the prohibited uses. Refunds are only available if no violations occur.

5. Fees and Payment Terms

Pricing Structure:

  • Yearly or monthly membership fees apply.
  • Additional charges may occur if usage exceeds the monthly allocation.

Billing and Payment:

  • Payment is processed via credit/debit card.
  • Membership requires a minimum 6-month commitment.

Refund Policy:
Refunds are at Napa Valley MIT’s discretion.

6. Content Policies

User-Generated Content:
No user-generated content is allowed on the platform.

7. Privacy and Data Protection

Data Collection:

  • Collection of financial and medical data complies with California Consumer Privacy Act (CCPA) and HIPAA.

Third-Party Sharing:
We do not share data with third parties.

Data Security:
All health data is encrypted and stored in compliance with HIPAA standards.

8. Liability and Warranties

Disclaimers:

  • Napa Valley MIT is not liable for the actions of independent healthcare staff.
  • Liability for performance of IV services lies with the individual nurse.

Limitation of Liability:

  • Napa Valley MIT is not responsible for service interruptions, data loss, or user disputes.
  • Reasonable efforts will be made to protect client data.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the State of California.

Arbitration Clause:
Disputes shall be resolved through binding arbitration, waiving the right to a court trial.

10. Modification of Terms

Napa Valley MIT reserves the right to update these Terms and Conditions. Notice will be sent via email. Continued use of the services constitutes acceptance of the changes.

11. Miscellaneous Clauses

  • Severability: If any part of these Terms is found unenforceable, the remaining sections stay in effect.
  • Entire Agreement: These Terms constitute the entire agreement between Napa Valley MIT and the user.

Assignment: Napa Valley MIT may transfer its rights or obligations to another party.
